These Terms and Conditions (“Terms”) govern your access to and use of https://accugenltd.com (the “Site”), including all online forms, client portals, file uploads, and related services. The Site is operated by AccuGen Accounting Ltd. (“AccuGen,” “we,” “us,” or “our”).
By accessing or using the Site, submitting information, uploading documents, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Use of the Website
You may use this Site only for lawful purposes. You agree not to:
- attempt unauthorized access to the Site, systems, or data;
- interfere with Site functionality or security;
- upload malicious software or harmful code;
- submit false, misleading, or fraudulent information.
We reserve the right to restrict or terminate access to the Site at our discretion.
2. No Professional Advice on the Website
Content on this Site is provided for general informational purposes only and does not constitute accounting, tax, legal, or professional advice.
Use of this Site or submission of inquiries does not create a client relationship. A client relationship exists only after:
- acceptance of engagement by AccuGen, and
- agreement on scope, fees, and terms (written or electronic).
3. Engagement, Estimates, and Advance Payment
Any estimate provided by AccuGen is non-binding and based on information available at the time.
To commence work:
- A minimum advance payment of 25% of the estimated fees is required.
- Work will not begin until the advance payment is received.
Final fees may vary depending on complexity, completeness of information, and additional work required.
4. Client Responsibilities and Accuracy of Information
You are responsible for:
- providing complete, accurate, and timely information;
- promptly advising us of changes that may affect your tax filings;
- reviewing all returns and documents prior to approval and filing.
We rely on information you provide. AccuGen is not responsible for errors, penalties, interest, reassessments, or delays arising from:
- incomplete or inaccurate information;
- missing documents;
- late responses or approvals from you or third parties.
5. E-Filing, T183 Authorization, and Payment Requirement
For personal and corporate tax filings:
- We e-file only after:
- receiving a signed T183 / T183CORP through our official e-signature link sent by email, and
- receiving full payment of the invoice.
- We will not submit returns without both authorization and payment.
No Responsibility for Late Filing:
AccuGen assumes no responsibility for interest, penalties, late-filing charges, denied refunds, or any other liability resulting from:
- unpaid invoices,
- unsigned or delayed T183 authorization,
- client unavailability or delayed responses.
6. No Refund Policy
All fees paid to AccuGen are non-refundable.
Once work has commenced, payments are final regardless of:
- client withdrawal,
- change of mind,
- decision not to file,
- outcome of CRA assessments.
This applies to advance payments, partial payments, and full payments.
7. Client Portal, Document Collection, and Submissions
We primarily collect information and documents through our secure client portal. Clients are encouraged to upload documents directly through the portal whenever possible.
We may also accept documents and communications via:
- our official business email addresses, and
- business WhatsApp communications.
You acknowledge that:
- you are authorized to share documents submitted;
- documents submitted are free of malware;
- electronic transmission carries inherent risks despite reasonable safeguards.
8. Electronic Communications
By engaging with AccuGen, you consent to communication via:
- email,
- phone,
- secure portal,
- business WhatsApp.
Electronic communication may not be completely secure. You accept these risks and agree not to hold AccuGen liable for unauthorized access beyond reasonable control.

9. Third-Party Tools and Services
We may use third-party software, platforms, or services (e.g., e-signature tools, portals, CRA systems). We are not responsible for outages, delays, or failures caused by third parties beyond our control.
10. No Guarantee of Outcome
Tax outcomes depend on facts, documentation, and positions taken by CRA or other authorities. AccuGen does not guarantee:
- refunds,
- processing times,
- acceptance of tax positions,
- avoidance of audit or reassessment.
11. Intellectual Property
All Site content, including text, graphics, logos, forms, and layouts, is the property of AccuGen Accounting Ltd. and may not be copied, reproduced, or distributed without prior written consent.
12. Limitation of Liability
To the fullest extent permitted by law, AccuGen shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- use of the Site,
- reliance on submitted or third-party information,
- delayed filings due to client actions,
- electronic communication risks,
- CRA decisions or assessments.
If liability cannot be excluded, it is limited to fees actually paid for the specific service giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless AccuGen and its directors, officers, employees, and contractors from any claims, damages, losses, or expenses arising from:
- breach of these Terms,
- misuse of the Site,
- false or incomplete information provided by you,
- violation of laws or third-party rights.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes shall be resolved exclusively in Ontario courts.
15. Changes to These Terms
We may update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Site or services constitutes acceptance of the updated Terms.
